Delegation of the Federation of Bosnia and Herzegovina: Mr. Rešad Žutić, director of Agency for privatization in the FBiH, Mr.Vahid Dupovac, assistent director for Passive Sub-Balance and disputable assets in APF, Mr.Muris Hafizović, director of the Administrative Office for assigned production and prof.dr.Miloš Trifković, legal advisor of APF, have discussed in Belgrade with representatives of Yugoimport/SDPR on the topic of claims and liabilities of companies from Bosnia and Herzegovina, made through operations through SSNO SDPR.

Representatives of Yugoimport-SDPR emphasized that their aim is to solve rights and liabilities, made by companies from ex- SFRY, during operations through SSNO SDPR. Claims and liabilities towards Iraque have a priority, because of the sum and a phase of cnsolidation of  Iraque debt towards abroad.

Yugoimport-SDPR proposed the following cooperation methodology:

• Identification of debts and claims of companies from Bosnia and Herzegovina,
• Identification of opened issues concerning identification,
• Definition of active legitimation of Agency for privatization towards Yugoimport-SDPR,
• Keeping an attitude that claims and debts have a commercial character towards Iraque Government (Ernst&Young, British financial consultant and Ministry of Finance of Iraque) .

During settlement of claims and liabilities with Ernest&Youngom, financial advisors and Government of Iraque, Yugoimport-SDPR will further act as a commissioner, meaning that no decision will be brought without approval of  creditors.

Representatives of Agency for privatization explained a legal base, upon which they became titles of claims and liabilities mentioned in Passive Sub-Balance, giving legal provisions of getting active legitimation of Agency for privatization. By authorization of the prime minister of Government of the Federation of Bosnia and Herzegovina, Agency for privatization is accepted as the only authorized entity for all claims and liabilities from Passive Sub-Balances, including those from Iraque. It is agreed that in the future time contacts will be made with Agency for privatization, i.e. through the Sector for  Pasive Sub-Balance and dispuable assets. Companies from Federation of Bosnia and Herzegovina can be consulted, asked for their participation in procedure of determination and realization of rights and liabilities, but in Yugoimport-SDPR can appear only giving a technical help to Agency for privatization.

As a program for privatization of assigned industry in the Federation of Bosnia and Herzegovin is completed, Passive Sub-Balances are accepted, and Agency for privatization is legally defined owner of claims and liabilities from assigned industry, based upon business operations with Iraque and other states (Switzerland, Angola, Syria, Peru and others).

Representatives of Agency for privatization expressed a fact that Agency is to check all claims and liabilities, and that a decision on final accepting or not accepting offered solutions should be brought by Government of the Federation of Bosnia and Herzegovina.

Representatives of Yugoimport-SDPR asked for explanation of the position of doubled companie in Bosnia and Herzegovina, in order Yugoimport-SDPR shoul be saved from double requests.

Because of the complexity of this problem, Agency for privatization i the FBiH asks that Government of the Federation of Bosnia and Herzegovina and other bodies and institutions, authorized to protect the state property, expert help and support, all because of protection of assets, rights and liabilities from  Passive Sub-Balance.
